1.1 The Guaranteed Plumbing - Terms & Conditions of Quotation form, together with these Terms and Conditions of Trade, constitute the complete agreement governing our quotations and services.

1.2 All quotations provided by Guaranteed Plumbing are valid for a period of 30 days from the date of creation. A deposit of 50% of the quoted amount is required before commencing the work.

2.1 Once a Work Order has been received or a job has been booked online and accepted by Guaranteed Plumbing, cancellation is only possible with the express consent of Guaranteed Plumbing and no later than 48 hours before the scheduled date. If Guaranteed Plumbing has already ordered goods from a third party, the cancellation will be subject to their return policy and any applicable restocking fees.

2.2 Guaranteed Plumbing reserves the right to cancel the supply of goods or services at any time after acceptance of a Work Order in writing. We shall not be liable for any loss or damage suffered by the Client as a result of such cancellation.

3.1 Acceptance of a Work Order assumes that all existing installations comply with applicable laws, regulations, and Australian Standards. If any work is required to bring existing installations into compliance, it will be carried out in addition to the requested work. Any variations will be communicated and recorded against the job.

3.2 In the event that, during authorized work, Guaranteed Plumbing discovers any defect in the premises or existing installations that renders it impracticable or inexpedient to continue, we may, at our sole discretion, conduct necessary repairs to proceed with the work.

3.3 The Client acknowledges that pipes affected by root growth and/or blockages are typically damaged due to such interference. Removal of root growth and/or blockages does not guarantee the prevention of similar problems unless Guaranteed Plumbing's Sani-Foam Vaporooter treatment has been completed on the affected pipework.

3.4 In cases where drain inspection or plumbing equipment becomes jammed due to damaged drains or blockages, Guaranteed Plumbing is entitled to take reasonable action to retrieve such items. The Client agrees to pay for the removal costs of the equipment, including any necessary excavation and restoration work.

3.5 Guaranteed Plumbing will take reasonable care to minimize any disturbance or damage to surrounding areas, including walls, ceilings, floors, cabinetry, and fixtures within the premises while supplying goods or services. The Client is responsible for any repair or restoration required after the supply of goods or services, at their own cost.

3.6 Any materials removed from the client's premises during the course of a Work Order and not used on the job shall be considered the property of Guaranteed Plumbing unless otherwise agreed.

3.7 In cases where excavation is required, Guaranteed Plumbing shall not be held liable for the reinstatement of grass, plants, pressure cleaning of driveways and paths, or the reinstatement of any other structures or fixtures that need to be removed for the work to be completed. Upon request, we can facilitate the involvement of respective professionals for these tasks, with the costs to be borne by the Client.

4.1 Guaranteed Plumbing shall perform all work in accordance with applicable Australian Standards, ensuring professional execution.

4.2 We shall comply with all relevant Occupational Health and Safety (OH&S) requirements in the performance of our work.

4.3 Guaranteed Plumbing shall handle any fixtures, fittings, materials, and/or equipment the Client provides with reasonable care.

4.4 We shall not be liable for any damage caused by defects in or the unsuitability/warranty process of client-supplied fixtures, fittings, materials, and equipment for their intended purposes.

4.5 Guaranteed Plumbing shall not be held liable for any loss or damage resulting from acts of God, fire, natural disasters, Acts of Parliament, Government orders, strikes, wars, delays in delivery of manufacturing materials, or any other circumstances beyond our control.

4.6 We reserve the right to subcontract any obligations or rights without the Client's consent.

4.7 Guaranteed Plumbing shall maintain appropriate insurance coverage for the supply of goods and services, as well as comply with all other insurances required by law.

4.8 In the event that the estimated cost is expected to be exceeded, Guaranteed Plumbing will seek approval from the client before proceeding with additional work. The client acknowledges and accepts responsibility for any costs incurred up to that point.

5.1 In certain situations, Guaranteed Plumbing may utilize specialized equipment to diagnose, locate, or address issues related to underground services.

5.2 The use of specialized equipment is dependent on various factors, including the nature of the problem, accessibility, and feasibility.

5.3 While every effort will be made to accurately diagnose and resolve issues using specialized equipment, please be aware that there may be limitations due to factors beyond our control, such as soil conditions, hidden obstructions, or unforeseen circumstances.

5.4 Guaranteed Plumbing shall not be held liable for any unforeseen challenges encountered during the use of specialized equipment or for any damages arising from such challenges.

5.5 Guaranteed Plumbing cannot provide exact quotes for repairing and locating obscured and underground services. Due to their hidden nature and complexity, the actual conditions may differ from initial assessments. Therefore, the final cost will be determined based on the actual work required. The Client acknowledges and accepts that the quoted amount may vary due to unforeseen circumstances associated with obscured and underground services.

6.1 Any pricing estimates provided by Guaranteed Plumbing are based on the information available at the time of the estimate.

6.2 It is important to note that estimating the cost of underground services can be challenging due to the inherent uncertainties and variables involved.

6.3 The final amount invoiced may vary from the initial estimation based on factors including, but not limited to, the complexity of the issue, unforeseen complications, necessary additional repairs, or changes in the scope of work.

6.4 Guaranteed Plumbing shall make reasonable efforts to inform the Client of any significant deviations from the initial estimation before proceeding with additional work or incurring additional costs.

6.5 The Client acknowledges and understands that the final invoice amount may not align precisely with the initial estimation due to the aforementioned factors.

7.1 Underground services, such as pipes, cables, or other utility lines, are inherently complex, and their conditions and locations may not always be fully visible or accurately known.

7.2 While Guaranteed Plumbing employs industry-standard practices and equipment to minimize risks, the presence of underground services can present challenges and uncertainties.

7.3 It is important to note that during the course of work involving underground services, unexpected conditions or damages may arise that were not apparent or foreseeable during the initial assessment.

7.4 Guaranteed Plumbing shall take reasonable precautions to prevent damages to underground services, but in the event of any unforeseen circumstances or damages, we shall not be held liable for any resulting costs, repairs, or disruptions, unless caused by our negligence or willful misconduct.

8.1 If the Client supplies fixtures, fittings, materials, and/or equipment, they shall be stored, handled, and installed at the Client's risk. Guaranteed Plumbing shall not be liable for any failure of materials supplied by the Client.

8.2 Title in the goods supplied by Guaranteed Plumbing shall remain with us until the Client has made the full payment. We reserve the right to reclaim goods from the Client's possession, custody, or control, even if they have been delivered or moved from the original delivery address. Guaranteed Plumbing may keep or sell the goods accordingly.

8.3 Any materials removed from the Client's site/premises shall be deemed the property of Guaranteed Plumbing unless otherwise agreed in writing.

9.1 The Client shall pay Guaranteed Plumbing the agreed Contract Price, including any additional costs incurred due to variations or additional work requested by the Client, as outlined in the quotation or as agreed upon in writing.

9.2 Payment terms are strictly 7 days from the date of invoice unless otherwise agreed upon in writing.

9.3 In the event of late payment, Guaranteed Plumbing may charge interest at a rate of 2% per month or part thereof on any overdue amounts.

9.4 If the Client fails to make payment by the due date or breaches any provision of this Agreement, Guaranteed Plumbing may suspend any further work and exercise any other rights available under the law or this Agreement.

10.1 In the event of any dispute arising out of or in connection with this Agreement, the parties shall attempt to resolve the dispute amicably through negotiation and discussion.

10.2 If the dispute cannot be resolved through negotiation, the parties may pursue mediation or other alternative dispute resolution methods before resorting to litigation.

11.1 This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions, negotiations, and agreements, whether written or oral, relating to the subject matter herein.

11.2 Any modifications or amendments to this Agreement must be in writing and signed by both parties.

12.1 This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Guaranteed Plumbing operates.
